Besigye Proceeds to High Court Amid Protest

Opposition Forum for Democratic Change’s Col Dr. Kizza Besigye has instructed his lawyers to proceed to the High Court after the case he had filed before the Kasangati Magistrates Court was recalled.

In the case, he sued the Inspector General of Police Gen Kale Kayihura and Kampala North RPC Wesley Nganizi, challenging their deployment at his house.

Prosecution yesterday unsuccessfully tried to stop the hearing of the case in the Kasangati court, and the magistrate Prossy Katushabe was set to deliver her overall ruling today.

Last evening however, she received instruction to transfer the case file to the High Court’s Criminal Division under unclear circumstances.

The development sparked a mild protest by some of Besigye’s supporters who had gone to the court for the ruling.

These marched to Besigye’s home in Kasangati and exchanged for minutes with anti-riot police which had headily deployed in the area.

Counsel Yusuf Nsibambi at the Magistrates Court told the media that after consulting with Besigye, they resolved to follow the case to the High Court having been left with no option.

“Our client is not happy with the way the judiciary is being used by the state. We will proceed to the High Court but in protest,” said Nsibambi.

The lawyer noted that the manner in which the case was recalled was intentional and out of order.

“Ruling was just the next day and the case is called for review, they would have waited for the ruling today and thereafter filed an appeal in case it wasn’t in their favor.”
