
Nakawa chief magistrate’s court has ordered the immediate and unconditional release of Ben Zziwa Kafuuma who has been in Jinja police custody for 23 days in relation to the murder of city businessman Wilberforce Wamala who was killed in 2012.
Magistrate Christine Nantege today directed the Director of Public Prosecutions or the Attorney General to either set free Zziwa or produce him in courts of law and charge him formally.
This came after Zziwa’s lawyer Jacqueline Namazzi convinced the magistrate that police is unlawfully detaining Zziwa beyond the 48 hours in which it’s mandated to release him on bond or produce him before court.
Police arrested Zziwa as the prime suspect in the famous murder, after several years of investigation.
Mr. Wamala was killed at his home in Mutungo Kampala on February 3, 2012. He was killed together with his gardener Sadiq Mugerwa.
Zziwa was second suspect in Police custody, the first one Hassim Ssali having allegedly committed suicide in a police cell.
