
Despite Inspector General of Police Gen Kale Kayihura’s directive for police officers to vacate Col Kizza Besigye’s home, the latter’s lawyers led by Counsel Fredrick Mpanga have vowed to continue with the case before Kasangati Grade One magistrate court challenging the unlawful incarceration of Dr Besigye at his home in Kasangati without producing him to any court of law.
Today the High Court judge Justice Elizabeth Kabanda dismissed the DPP’s application challenging the Kasangati magistrate’s decision to recall the file of this case which she had already dismissed.
On hearing the news of the IGP’s directive, Mpanga told reporters that they would not base on Kayihura’s decision because it can change any time, leading to further oppression of his client.
“We have to continue with this matter so that we can get a court order against this maltreatment of our client. You never know, the police officers can be withdrawn at 1pm and in the evening they are back,” he said.
He further explained that Police withdraw from Dr Besigye’s home today doesn’t change anything in the matter of unlawful detention of Besigye beyond 48 hrs without being charged.
In her judgment, Justice Kabanda ordered the file to be returned to Kasangati court and ordered the hearing of the case to commence as soon as possible, first by addressing merits of the case.
