Besigye Returns to Court Tomorrow

The Constitutional Court has fixed tomorrow Friday to hear the petition filed by the Attorney General against Forum for Democratic Change and Col Kiiza Besigye’s defiance campaign activities.

This case will be heard by a panel of five Justices namely; Deputy Chief Justice Stephen Kavuma , Richard Buteera, Elizabeth Musoke , Catherine Bamugemereire  and Cheborion Barishaki.

Col Besigye who on remand in Luzira in treason charges, is also expected to attend this hearing.

The Attorney General in this petition wants court to permanently ban FDC defiance activities including weekly prayers, demonstrations and making continued demands of an international independent audit of the presidential election results.

The Attorney General says the above activities  should be declared as unconstitutional  because they do not conform to the prescribed  means and processes of challenging a presidential result ;and in any case the  Supreme  Court  which is the highest court of this land has already pronounced itself  and declared the winner of the election.

The Attorney General therefore contends that unless FDC and Besigye are restrained from these activities, the country is headed for lawlessness and breach of public peace.

However it should be remembered that Thursday last week the Attorney General withdrew two interim applications against both Besigye and FDC in which he had sought to temporarily block these activities until the hearing and disposal of the main petition.

Besigye wrote to court on the same day, seeking more time within which to file his response to the petition as he must also appear in person to defend himself.
