State Appeals Against Sodomy Convict Mubiru’s Acquittal

The Director of Public Prosecutions (DPP) has appealed against the acquittal of former SC Villa coach Christopher Mubiru on sodomy charges.

Through State Attorney Jacqueline Okui, the DPP filed a notice in the Court of Appeal showing his dissatisfaction with the High Court decision that quashed Mubiru’s 10 year jail punishment for sodomizing 17 year old Emmanuel Nyanzi.

The notice also alerts the High Court criminal registry to prepare the record of proceedings to enable the DPP file reasons for his appeal.

On the 19th of April/2016, High Court Judge Wilson Masalu Musene freed Mubiru from Luzira prison after faulting Buganda Road Chief Magistrates’ Court for convicting and sentencing Mubiru to a harsh punishment in the absence of strong ‘anal penetration’ evidence of Nyanzi.

Mubiru was charged with having canal knowledge of a person against the order of nature, which he allegedly committed in 2009 at Kisingiri zone in Mengo Rubaga division.
