
Court assessors in the case where 13 people are accused of participating in the July 2010 bombings where 76 people perished, have given court their opinion on this matter.
The two assessors Mr. Lubega Robert Seguya and Mrs. Juliet Kasendwa Aligaweesa each presented opinions and advised court accordingly.
In his opinion, Mr Lubega asked court to convict all the accused persons on 76 counts of murder and 10 counts of attempted murder.
He argued that prosecution witnesses who were brought to testify especially Prosecution witness number 1 (PW1) and Pw2 directly trained with some of the accused and so there testimony proved this act beyond reasonable doubt.
He however advised court to acquit Accused 13 Muzafaru Luyima on the charge of being an accessory, because there was not enough evidence pinning him.
On the count of aiding and abetting the crime, Lubega asked court to convict the accused persons because they clearly knew what they were doing and that their defense was based on denial not the truth.
The second court Assessor Juliet Kasendwa in her opinion advised court to convict the 11 accused persons on the count of terrorism as the evidence which was produced was enough to prove the case beyond reasonable doubt.
She however asked court to acquit A6 Yahaya Sulaiman Mbuthia on this case for lack of pinning evidence.
For the case of Murder and attempted murder, Kasendwa advised court to convict the 11 and set free the 6th Accused Sulaiman Mbuthia because the evidence didn’t prove the case beyond reasonable doubt.
She also asked court to set free A6 Yahaya Sulaiman Mbuthia and A13 Muzafaru Luyima who are on the count of Being an Accessory after the fact saying that there was no enough evidence pinning them on this act.
Justice Alifonsi Owinyi Dollo has set the 18th May 2016 to pronounce his judgment in this case which is one of the oldest cases before the High court.
