
High Court judge Justice Wilson Masalu Musene has released Gen David Sejusa on a Shs. 10million cash bail as well as shillings 50million non-cash bail to each of the two sureties that stood for him.
In the session held amidst heavy deployment of Military Police men, ordinary police and Prisons officers, Sejusa asked for bail on a number of grounds, all of which court found satisfactory.
The former Intelligence Coordinator produced two sureties namely, Kampala Lord Mayor Salongo Erias Lukwago and Dr Deo Lukyamuzi a surgeon with Case Clinic in Kampala.
Unlike the Makindye Court Martial where Sejusa first applied for bail, the High Court found these sureties credible.
Justice Musene was also convinced by Sejusa’s claims that he has a fixed place of aboard in Naguru, he is of advanced age (62); that bail is his constitutional right and that he is his family’s sole bread winner.
Sejusa rushed to the High Court after the General Court Martial in Makindye refused him bail after his civilian sureties were found not substantial.
The High Court last month issued an order discontinuing Sejusa’s trial in the army court and advised him to reapply for bail in the High Court’s Criminal Division.
Now that criminal charges were suspended, Judge Musalu said it would be unlawful to keep the applicant in prison when there is no appeal against the High Court ruling (suspending the trial at Court martial).
“In this case where there is no trial taking place, court can’t fold back its hands on this matter, High court has unlimited jurisdiction and this cannot be changed unless when the constitution is amended,” he pointed out.
Judge Musene thus released Sejusa on bail and advised him to report to High Court every two weeks.
As soon as he was released, Sejusa accompanied by his wife Juliet Tinyefuza thanked the judiciary for helping him gain his constitutional right to bail.
“I thank everyone who has rendered a hand in this case so that I may become a free man. From the time I was taken Luzira thousands of people have been visiting me. I thank God for my family especially my wife and children who have stood by my side, bringing me foot to the Prison.”
