
High court judge Justice Yasin Nyanzi has Thursday released Nakawa Municipality Mp Michael Kabaziguruka on cash bail of Shs. 5million and a bond of 10million non-cash.
His four sureties on the other hand were given a Shs. 100million none cash bond.
The development came after the offices of the Directorate of Public Prosecution and the Attorney General decided to drop out of the bail application hearing.
The judge based on a number of factors to grant the bail, which included the fact that the parties involved, that is the Attorney General, UPDF and the DPP were all served with affidavits but none of them opposed this matter and decided to drop out of it.
“This court can’t hold its hands on matters like this where the applicant seeks to regain his freedom,” ruled the judge. “Instead the DPP and Attorney General who are respondents abandoned the matter.”
Justice Nyanzi called upon the lawmakers in the country to ensure that they put in place laws which can be used in addressing such circumstances whenever they arise.
All the sureties presented have been considered substantial basing on their identification documents presented to court as well as the offices they hold.
The sureties are: Kampala City Lord Mayor Erias Lukwago, FDC Chairperson Maj Gen Mugisha Muntu, Hon Kasibante Moses and Hon Semujju Nganda, all of who presented to court their passports and National Identity cards.
