Kabaziguruka Edges to Freedom as DPP Drops Out of Case

High Court Judge Justice Yasin is set this afternoon to deliver his ruling on the bail application filed in court in which Nakawa MP Michael Kabaziguruka seeks be released on bail from Kigo Prison where he was remanded by Makindye General Court martial over treachery charges.

Drama unfolded in court earlier today, when the Director of Public Prosecutions and the Attorney General excused themselves from participating in this matter, which prompted Justice Yasin Nyanzi to base on the precedent by Justice Wilson Masalu Musene where he proceeded with Gen David Sejusa’s bail application without respondents.

In his application filed in court by His lawyers led by Rwadsalus Rwakafuuzi, Kabaziguruka seeks bail on grounds that the mandatory period of 60 days provided in the constitution, in which an accused person can stay on remand before hearing of his case, have elapsed.

The MP has spent 100 days on remand without commencement of the hearing of the case in the Gen Court Martial.

He adds that he has a fixed place of abode In Luzira, which is under the jurisdiction of this court, and that it’s his constitution right as any Ugandan with a presumption of innocence to apply for bail.

As a proof that he will turn to court for his trial, Kabazigiruka presented four sureties including City Lord Mayor Erias Lukwago, FDC Chairperson Maj Gen Mugisha Muntu, Hon Kasibante Moses and Hon Semujju Nganda all who have presented to court their passports and National Identity cards.
